Terms of Service
Basic terms for using our Service.Please review the following to use the Service safely.
These Terms of Service (the "Terms") govern the rights, obligations, and responsibilities between Flexeam Corp. (the "Company") and its members ("Members") in connection with the use of the mobile application "Flexeam" (the "Service" or "App") operated by the Company, and set forth other necessary matters.
Article 1.Effect and Amendment of the Terms
- These Terms are posted through the "Flexeam" application, and a Member is deemed to have agreed to these Terms upon registering for or using the App.
- The Company may amend these Terms to the extent it does not violate applicable law, and will notify Members of any changes through notices and in-app announcements.
- If a Member does not agree to the amended Terms, the Member may terminate use of the Service by withdrawing their membership.
- A Member is deemed to have agreed to these Terms upon installing the App and completing registration, and this shall be deemed confirmation that the Member meets the minimum age to use the Service set forth in Article 3.
Article 2.Provision of the Service
- The App provides a Service that includes the following features:
- MemeTalk (Chat): Sharing text, voice, Ticony (emoticons), contacts, Lounge, Tree, Roots, and other content between users, with commenting features.
- Tree (Short-form): Uploading and sharing short-form videos.
- Roots (Social): SNS features for uploading and sharing multiple photos and videos.
- Ticony (Emoticons): Creating and sharing custom emoticons made from images or videos, with commenting features.
- Planet (Community): Creating and joining chat rooms based on shared interests.
- Lobby (Profile): Uploading photos and videos, and accessing profile page features.
- Lounge (Branding): User brand page features.
- Stream: Streaming users of interest to view their activity.
- Crew: A mutual connection formed between users who have streamed each other, providing activity notifications and connection features.
- Friends: A relationship formed based on contacts, where users may choose their preferred sync method (Auto, Private, or Disabled).
- Story: Recommending Tree/Roots posts based on media stored on the user's device.
- FreeTalk: Open chat recommended based on shared interests, a community-style chat feature that anyone can join.
Article 3.Registration and Withdrawal
- A Member applies to use the Service through the method designated by the Company (phone verification), and the service agreement is concluded when the Company approves the application (verification code).
- A Member may request withdrawal at any time. Upon withdrawal, the Member's data is deleted without delay in accordance with the Privacy Policy, except for information required to be retained under applicable law.
- The Service is only available to users aged 14 or older. The Company provides the Service based on the age rating provided by app marketplaces (App Store, Google Play, etc.) and the registration information provided by the user, and by agreeing to these Terms upon registration, the Member is deemed to have confirmed that they are 14 years of age or older. If the Company processes the personal data of a Member under the age of 14, the consent of a parent or legal guardian is required under the Personal Information Protection Act of Korea; further details are governed by the Privacy Policy.
Article 4.Permissions and Access
- The Company provides the Service using the following access permissions. All permissions are provided optionally with user consent, and declining consent may limit the use of certain features.
- Approximate location (IP-based): Used to provide fast and smooth service through servers based on the user's connecting region. Real-time location permissions such as device GPS are not currently used; separate consent will be obtained if location-based features are introduced in the future.
- Contacts: Used to form contact-based friend relationships (optional). Users may choose their preferred sync method among Auto, Private, or Disabled, and contact information is not provided to third parties.
- Media (photos/videos): Used for uploading and editing content (Tree, Roots, messages, Ticony, etc.).
- Camera: Enables live capture and posting of content.
- Audio/microphone: Supports audio recording, uploading, and voice messages.
- Storage: Used for temporary storage, media sharing, and downloads.
- Push notifications: Used to deliver in-app news.
Article 5.Content and Copyright
- Members hold the rights to, and are responsible for, all content (images, videos, audio, etc.) they upload to the Service.
- By posting content on the Service, a Member grants the Company the right to store, reproduce, transmit, and display such content for the purpose of providing, operating, and promoting the Service. This right terminates immediately upon the Member's deletion of the content or withdrawal from the Service.
- The Company assumes no legal responsibility, including for copyright disputes, regarding content posted by Members.
- Members must not post content that infringes the copyrights of others, and shall bear full legal responsibility for any such infringement.
- If a copyright holder submits a takedown request supported by substantiating materials (e.g., a copyright registration certificate or power of attorney), the Company will remove or temporarily restrict access to the content and notify the poster, who may then request reinstatement.
Article 6.Restrictions on Use and Prohibited Conduct
- If the Company discovers conduct that violates the following prohibitions, it may, after providing advance notice stating the reason, remove content, restrict use of the Service, suspend the account, or take legal action. However, for urgent unlawful content such as illegally filmed material or child sexual abuse material (CSAM), the Company may take action first and provide notice afterward.
- Abusive language, defamation, insults, or other unethical expressions
- Content that causes sexual shame or is obscene
- Content that may cause offense, such as racial discrimination, hate speech, self-harm, suicide, or abuse
- Excessive violence or promotion of criminal activity
- Content depicting sexual exploitation, abuse, or violence against children
- Illegally filmed material or infringement of another person's likeness or privacy rights
- Advertising, promotional, or commercial spam posts
- Upon discovering a violation, the Company may take measures such as a warning, temporary suspension, or account suspension, and will notify the Member of the reason. A Member may raise an objection within 15 days of the measure being taken, and if the objection is found to be valid, the Company will immediately lift the measure.
Article 7.Reporting and Response
- A Member who discovers a violation may report it through the in-app reporting feature or by email.
- We will provide the results of our initial review within 24 hours of receiving a report and will respond as promptly as possible.
- We ensure a fair process so that neither the reporting party nor the reported party is disadvantaged.
Article 8.Contacts Permission and Privacy
- The Company may access a user's contact information to form contact-based friend relationships, and this is done only with the user's explicit consent.
- The Company does not provide or share collected contact information with third parties, except that storage and processing entrustment through cloud infrastructure for the provision of the Service is governed by the Privacy Policy.
- You may choose one of the following three contact sync methods:
- Auto mode: Contacts are registered automatically, and a friend connection is formed automatically if the other party is also a Service user.
- Private mode: Only contacts you select are registered as friends. If you select Disabled mode, the contact-based friend registration feature is not used.
- Friend relationships formed through the above methods are separate from interest-based recommendations (Planet, FreeTalk, etc.) and are not used in any recommendation algorithm.
- You may change or disable contacts permission and the sync mode at any time through the App settings, in which case the automatic friend registration feature may be limited.
- If you do not grant this permission, use of the contact-based friend registration feature may be limited.
Article 9.Disclaimer
- The Company is not responsible for the reliability or accuracy of information, materials, or facts posted or transmitted by users within the Service.
- The Company is not liable for interruptions to the Service caused by force majeure events such as natural disasters, technical failures, or maintenance.
- Except in cases of the Company's willful misconduct or gross negligence, the Company is not liable, to the extent permitted by applicable law, for damages arising from minor negligence.
- The Company has no obligation to intervene in disputes arising between Members, or between a Member and a third party, in connection with the Service, and bears no liability for any resulting damages.
- The Company is not responsible for services or content provided by third parties that are accessible through links included in the Service.
- The Service is currently provided free of charge. If paid services are introduced, matters concerning payment, withdrawal of subscription and refunds, and the right of minors to cancel contracts will be separately announced in accordance with applicable law.
- The Company is not liable for damages arising from a Member's own fault, such as failure to properly manage account information (passwords, verification codes, etc.) or unauthorized use of the account.
- Images and videos shared in chat rooms may be automatically deleted after 3 days, and the Company is not liable for any resulting loss of content. Members should separately save any content that is important to them.
Article 10.Suspension of Service
- The Service may be temporarily suspended due to system maintenance, urgent security issues, or similar reasons. If the Company terminates all or a material part of the Service, it will provide notice 30 days in advance.
Article 11.Governing Law and Dispute Resolution
- These Terms shall be interpreted in accordance with the laws of the Republic of Korea.
- These Terms shall be interpreted in accordance with the laws of the Republic of Korea, and in the event of a dispute between the Company and a Member, an action may be brought before a court of competent jurisdiction under the Korean Civil Procedure Act.
Article 12.Miscellaneous
- Matters not specified in these Terms shall be governed by applicable law or general commercial practice.
- Members may view the Privacy Policy on the Company's website at any time.
- These Terms and related policies may be amended after advance notice when deemed necessary.
- These Terms are provided primarily in Korean and may also be provided in other languages; however, the Korean version shall govern in the event of any conflict.
- These Terms are effective as of May 22, 2025.
